How Cheffix collects, uses and protects your personal data in line with the GDPR, the rights you have and how long we keep your data.

Dena Textile Productions B.V. operates this shop and website, including all related information, content, features, tools, products and Services, in order to provide you, the customer, with a personalised shopping experience (the "Services"). Our store runs on the Shopify platform, which enables us to provide the Services to you. This privacy policy describes how we collect, use and disclose your personal information when you visit, use or make a purchase or other transaction, or otherwise communicate with us. If there is a conflict between our terms of service and this privacy policy, this privacy policy prevails with respect to the collection, processing and disclosure of your personal information.

Please read this privacy policy carefully. It explains how we collect, use and share your personal information and what rights you have in this regard. We request consent for non-essential cookies and the associated processing (such as statistics and marketing) separately via our cookie banner; you can withdraw that consent at any time via the "Cookie settings" link at the bottom of every page.

Personal information we collect or process

When we use the term "personal information", we mean information that identifies you or another person or can reasonably be linked to you or another person. Personal information does not include information that has been collected anonymously or that has been de-identified so that it cannot identify you or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live and as permitted or required by applicable law:

  • Contact details, including your name, address, billing address, delivery address, telephone number and email address.
  • Financial information, including credit card, debit card and financial account numbers, payment card information, financial account information, transaction data, payment method, payment confirmation and other payment details.
  • Account details, including your username, password, security questions, preferences and settings.
  • Transaction data, including the items you view, add to your shopping cart, add to your wishlist or purchase, return, exchange or cancel, and your previous transactions.
  • Communications with us, including the information you include in your communications with us, for example when submitting a customer support query.
  • Device data, including information about your device, browser or network connection, your IP address and other unique identifiers.
  • Usage information, including information about your interaction with the Services, including how and when you interact with or navigate through the Services.

Sources of personal information

We may collect personal information from the following sources:

  • Directly from you, including when you create an account, visit or use the Services, communicate with us or otherwise provide us with your personal information;
  • Automatically through the Services, including from your device when you use our products or Services or visit our websites, and through the use of cookies and similar technologies;
  • From our service providers, including when we engage them to enable certain technology and when they collect or process your personal information on our behalf;
  • From our partners or other third parties.

Cookies and analytics

Our website uses cookies and similar techniques. We always place necessary cookies to ensure a properly functioning and secure webshop. For statistics we use, solely with your consent, Google Analytics and Microsoft Clarity; for marketing we may, likewise with your consent, use the Meta pixel. We request this consent via our cookie banner (legal basis: Article 6(1)(a) GDPR). You can change or withdraw your choice at any time via the "Cookie settings" link at the bottom of every page. How we use your personal information

Depending on how you communicate with us or which of the Services you use, we may use personal information for the following purposes:

  • Providing, tailoring and improving the Services. We use your personal information to provide you with the services, including to perform our contract with you, to process your payments, to handle your orders, to remember your preferences and the items you are interested in, to send you notifications relating to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange shipping, to facilitate any returns and exchanges, to enable you to post reviews and to create a tailored shopping experience for you, such as recommending products related to your purchases. This may involve using your personal information to better tailor and improve the Services.
  • Marketing and advertising. We use your personal information for marketing and promotional purposes, such as sending marketing, advertising and promotional messages by email, text message or post, and to show you online advertisements for products or Services on the Services or other websites, including based on items you have previously purchased or added to your shopping cart and other activity on the Services.
  • Security and fraud prevention. We use your personal information to verify your account, to provide a secure payment and shopping experience, to detect, investigate or take action against possible fraudulent, illegal, unsafe or malicious activity, to protect public safety and to secure our Services. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We strongly recommend that you do not share your username, password or other access details with anyone else.
  • Communicating with you. We use your personal information to provide you with customer support, to respond to you, to provide you with effective Services and to maintain our business relationship with you.
  • Legal reasons. We use your personal information to comply with applicable law or to respond to valid legal process, including requests from law enforcement or government authorities, to investigate or participate in potential or actual litigation or other legal proceedings, and to enforce or investigate potential violations of our terms or policies.

How we disclose personal information

In certain circumstances we may disclose your personal information to third parties for legitimate purposes subject to this privacy policy. Such circumstances may include:

  • With Shopify, vendors and other third parties who perform Services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and shipping);
  • With business and marketing partners to provide marketing Services and to advertise to you; For example, we use Shopify to support personalised advertising with third-party Services based on your online activity across various merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you live, you may have the right to ask us not to share information about you in order to show you targeted advertising and marketing based on your online activity across various merchants and websites.
  • When you instruct us, request us or otherwise consent to us providing certain information to third parties, such as to ship your products or through your use of social media widgets or login integrations.
  • With our affiliates or otherwise within our group of companies.
  • In connection with a business transaction such as a merger or bankruptcy, to comply with applicable legal obligations (including responding to subpoenas, search warrants and similar requests), to enforce applicable terms of service or policies, and to protect or defend the Services, our rights and the rights of our users or others.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify, as well as third parties who may be located in countries other than where you live, in order to provide and improve the Services for you. In addition, to help protect, grow and improve our business, we use certain Shopify enhanced features that contain data and information obtained from your interactions with our shop, together with other merchants and with Shopify. To provide these enhanced features, Shopify may use personal information collected about your interactions with our shop, together with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over the use of your personal information for these purposes. The Services may contain links to websites or other online platforms operated by third parties. If you follow links to sites that are not affiliated with us or not operated by us, you should review their privacy and security policies and other terms and conditions. We give no warranty and are not responsible for the privacy or security of such sites, including the accuracy, completeness or reliability of the information found on these sites. Information you provide in public or semi-public places, including information you share on third-party social networking platforms, may also be viewed by other users of the Services and/or users of those third-party platforms without restriction as to its use by us or by a third party. Our inclusion of such links does not in itself imply any endorsement of the content on such platforms or of their owners or operators, except as stated in the Services.

Children's data

The Services are not intended for use by children, and we do not knowingly collect personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with his or her personal data, you can contact us using the contact details below to request that it be deleted. As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" personal data of persons under 16 years of age (as those terms are defined in applicable law).

Security and retention of your information

Please be aware that no security measure is perfect or impenetrable and that we cannot guarantee "perfect security". In addition, it is possible that information you send us may not be secure during transmission. We advise you not to use insecure channels to communicate sensitive or confidential data to us.

How long we retain your personal information depends on various factors, for example whether we need the information to maintain your account, to provide you with Services, to comply with legal obligations, to resolve disputes or to enforce other applicable contracts and policies.

The GDPR requires a legal basis and a retention period for every processing activity. Below you can read what we retain for which purpose, and why.

  • Fulfilling your order (name, address, email address, telephone number, order details, payment status). Legal basis: performance of the contract (Article 6(1)(b) GDPR). Retention period: seven years, because tax law requires this for our records (art. 52 Algemene wet inzake rijksbelastingen, the Dutch State Taxes Act).
  • Recording your acceptance of the terms (time, email address, language, which version of which document). Legal basis: legitimate interest in being able to demonstrate which terms applied (Article 6(1)(f) GDPR). Retention period: seven years, in line with the records it belongs to. We do not record an IP address for this purpose.
  • Customer account and dealer area (account details, company and branch details, order history). Legal basis: performance of the contract. Retention period: for as long as the account exists, and seven years thereafter for our records.
  • Complaints, returns and warranty (description, photos, correspondence). Legal basis: performance of the contract and the handling of a legal claim. Retention period: five years after settlement, in line with the limitation period.
  • Contact and custom order enquiries (name, email address, telephone number, your question). Legal basis: legitimate interest in answering your question, or steps taken prior to entering into a contract. Retention period: two years after the last contact.
  • Newsletter and offers (email address, opens and clicks). Legal basis: your consent (Article 6(1)(a) GDPR), which you can withdraw in every email. Retention period: until you unsubscribe, after which we only retain your unsubscription so that we do not approach you again.
  • Statistics and marketing cookies. Legal basis: your consent via the cookie banner. Retention period: as stated in the cookie statement; you can withdraw at any time via "Cookie settings" at the bottom of every page.
  • Fraud prevention and security (technical logs). Legal basis: legitimate interest in a secure webshop. Retention period: twelve months.

Who processes your data on our behalf

We engage service providers who process personal data on our behalf. A data processing agreement has been concluded with each of them. These are:

  • Shopify (Canada/Ireland): webshop platform, orders, customer accounts and the payment environment.
  • Vercel (US/EU): hosting of the websites.
  • Supabase (EU): database for, among other things, enquiries, complaints and the recording of acceptances.
  • Resend (US/EU): sending of transactional email.
  • Exact (Netherlands): bookkeeping, invoicing and accounts receivable management.
  • DPD (Netherlands/EU): delivery and returns.
  • Google (US/Ireland): statistics via Google Analytics, solely after your consent.
  • Microsoft (US/Ireland): statistics via Clarity, solely after your consent.
  • Meta (US/Ireland): advertising measurement via the Meta pixel, solely after your consent.

Where a processor processes data outside the European Economic Area, this takes place on the basis of an adequacy decision of the European Commission or of the standard contractual clauses.

Contact about your data

Do you have questions about your data, or a request for access, rectification or erasure? Email privacy@dena.nl. We respond within one month (Article 12(3) GDPR). If you disagree with the way we handle your request, you can lodge a complaint with the Autoriteit Persoonsgegevens (the Dutch Data Protection Authority) via autoriteitpersoonsgegevens.nl.

Your rights and choices

Depending on where you live, you have some or all of the rights set out below in relation to your personal information. However, these rights are not absolute, may only apply in certain circumstances, and in certain cases we may decline your request as permitted by law.

  • Right of access/knowledge. You may have the right to request access to personal information we hold about you.
  • Right to erasure. You may have the right to request that we delete personal information we hold about you.
  • Right to rectification. You may have the right to ask us to correct inaccurate personal information we hold about you.
  • Right to portability. You may have the right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and subject to certain exceptions.
  • Managing communication preferences. We may send you promotional emails, and you can choose at any time to stop receiving them by using the unsubscribe option displayed in our emails to you. If you unsubscribe, we may still send you non-promotional emails, for example about your account or orders you have placed.

If you live in the United Kingdom or the European Economic Area (EEA), and subject to exceptions and limitations provided by local law, you may exercise the following rights in addition to the rights described above:

  • Objection to processing and restriction of processing: You may have the right to ask us to stop or restrict the processing of personal information for certain purposes.
  • Withdrawal of consent: where we rely on consent to process your personal information, you have the right to withdraw that consent. If you withdraw your consent, this does not affect the lawfulness of the processing based on your consent before it was withdrawn.

We will not discriminate against you for exercising any of these rights. We may need to verify your identity before we can process your requests, as permitted or required under applicable law. In accordance with applicable law, you may designate an authorised agent to make requests on your behalf to exercise your rights. Before we accept such a request from an agent, we require the agent to prove that you have authorised them to act on your behalf, and we may ask you to verify your identity directly with us. We will respond to your request in a timely manner as required by applicable law.

Complaints

If you have complaints about the way we process your personal information, please contact us using the contact details below. Depending on where you live, you have the right to appeal our decision by contacting us using the contact details below, or to lodge your complaint with your local data protection authority.

International transfers

Please note that we may transfer, store and process your personal information outside the country where you live.

If we transfer your personal information outside the European Economic Area or the United Kingdom, we rely on recognised transfer mechanisms such as the European Commission's standard contractual clauses, or equivalent contracts issued by the relevant competent authority of the United Kingdom, where relevant, unless the data is transferred to a country that has been determined to provide an adequate level of protection.

Changes to this privacy policy

We may update this privacy policy from time to time, including to reflect changes in our practices or for other operational, legal or regulatory reasons. We will post the revised privacy policy on this website, update the "Last updated on" date and provide notice as required by applicable law.
